23.1

No
community shall be compelled to relocate in order to escape the impacts
of the Project. If any community or portion thereof chooses to relocate,
their entitlements pursuant to this Agreement shall not be dminished
by the mere fact of such relocation. |

23.2

The
onus shall be on Hydro to establish that the Projects did not cause
nor contribute to an adverse effect, where any claim arises by virtue
of an actual or purported adverse effect of the Project. |

23.3 |
Disputes between Canada and Manitoba and/or Hydro or between any two
of them as to the apportionment of liability or as to the apportionment
of costs attributable to the effects of the Project shall not be a cause
for the delay of any programs or projects where such programs or projects
are ordered pursuant to this Agreement or arise or have arisen as a
result of government policy. |
